nacahelmet.com is a website published by the company UFO (Allée d'Amsterdam, Parc d'Activités du plateau de Signes, 83700 SIGNES, with capital of 500,000 euros, registered with the RCS of Toulon n°438 953 697) and under its exclusive responsibility.

The NACA brand belongs to the company UFO and is used by the company S.A.S NACA under a license granted to it by the company UFO.

Motorcycle and bicycle helmets are marketed by the company S.A.S NACA. Riding helmets are, for their part, manufactured and marketed by the company UFO.

The general conditions of sale described below detail the rights and obligations of the company S.A.S NACA, Allée d'Amsterdam, Parc d'Activités du plateau de Signes, 83700 SIGNES, with capital of 534,320 euros, registered with the RCS of Toulon n °891 788 465, and its customers, in the context of the sale of the following products: NACA motorcycle helmets and bicycle helmets, and the rights and obligations of the company UFO, Allée d'Amsterdam, Parc d'Activités du Plateau de Signes, 83700 SIGNES, with capital of 500,000 euros, registered with the Toulon RCS n°438 953 697, and its customers, in the context of the sale of the following products: NACA riding helmets.

The NACA MOTO range of helmets meets the safety requirements according to European regulation ECE R22.05. The bicycle helmets are CE approved according to the standard according to EN1078+A1:2013. The helmets are made in France.

The riding helmets are CE approved according to standard EN1384:2017. They are made in France, by the company UFO.

Any service provided by the companies NACA and UFO therefore implies the buyer’s unreserved acceptance of these general conditions of sale.

In accordance with current regulations, the Supplier reserves the right to deviate from certain clauses of these General Conditions of Sale, depending on the negotiations carried out with the buyer, by establishing Special Conditions of Sale.

The Supplier may, in addition, be required to establish Categorical General Conditions of Sale, derogating from these General Conditions of Sale, depending on the type of customer considered, determined based on objective criteria. In this case, the Categorical General Conditions of Sale apply to all operators meeting these criteria.

Product

Each product on the NACAHELMET online sales site is accompanied by a description. The photographs of the products are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to the colors.

Any modifications requested by the buyer can only be taken into account, within the limits of the Supplier's possibilities and at its sole discretion, if they are notified in writing by email.

Payment terms

Payment for orders is made by one of the means listed below:

For each order, a request to debit the customer's bank account will be sent within 24 hours to their bank. The order will be considered effective after confirmation of the agreement of the bank payment centers. Customs duties:

Any order placed on the site and delivered outside France may be subject to possible taxes and customs duties which are imposed when the package reaches its destination (according to regulations in force in the country in which delivery takes place) .

S.A.S NACA and UFO are not required to check and inform its customers of applicable customs duties and taxes. Responsibility:

The seller, in the online sales process, is only bound by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.

The Buyer is responsible for the information he provides during the payment process via the order (in particular the email address and/or name and delivery address to which the information will be sent).

The Seller declines all responsibility in the event of an incomplete or incorrect email address and/or physical address and cannot be held responsible for the consequences of a possible error in this information (impossibility or delay in delivery of the product).

The Seller disclaims all liability in the event of non-execution of the order due to force majeure.

Archiving – Proof

The seller will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.

Title retention clause

The companies S.A.S NACA and UFO reserve, until full payment of the price by the Purchaser, a right of ownership over the products sold, allowing them to regain possession of said products. Any deposit paid by the Purchaser will remain with the Supplier as lump sum compensation, without prejudice to any other actions that it may be entitled to take against the Purchaser as a result.

However, the risk of loss and deterioration will be transferred to the Purchaser upon delivery of the ordered products.

All elements of the seller's site are and remain the intellectual and exclusive property of the seller.

No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site.


Delivery

Motorcycle helmets:

Helmets are produced and designed on demand. The maximum delivery time is 1 month from validation and payment of the order, unless otherwise specified before final validation of the order and subject to the accuracy of the data communicated.

Bicycle helmets:

The maximum delivery time is 14 days from validation and payment of the order, unless specific stipulation indicated before final validation of the order and subject to the accuracy of the data communicated.

Delivery times will be longer for products ordered with customization requests: for this type of request, contact us by email.

Horse-Riding helmets:

The maximum delivery time is 14 days from validation and payment of the order, unless specific stipulation indicated before final validation of the order and subject to the accuracy of the data communicated.

In the event of a delay, an email will be sent to you as soon as possible. The customer can choose to accept the new deadline or cancel their order. In the latter case, the supplier will then be required to reimburse the items concerned as quickly as possible.

The Supplier's liability cannot under any circumstances be incurred in the event of delay or suspension of delivery attributable to the Purchaser or in the event of force majeure.

Returns

Returns management: You must return the duly completed returns form to us by email after having requested it by email (contact@nacahelmet.com) or by telephone. You can download the form HERE.

You must tell us if you want a refund or an exchange.

Return period: You have a legal period of 1 month to exercise your right of withdrawal and cancel your sales contract, without giving a reason. After this period, we will no longer accept returns. The withdrawal period runs from the date of receipt of the order.

You benefit from a one-month trial on the headsets. If it does not suit you, it must be returned to us in perfect condition, in its original packaging. Any damaged, scratched, impacted or dropped helmet will not be refunded or exchanged.

The exchange or refund will only be effective after examination of the returned product, within a maximum of two months. Any product returned outside of the procedures described will not be accepted.

Any helmet that has been uniquely personalized cannot be returned.

The duly completed withdrawal form to be attached to the return package must be sent to contact@nacahelmet.com within one month from the date of receipt of the products;

Products must not be scratched, damaged or impacted

Products must be returned in their original packaging;

The products must be in perfect condition. Only shipping costs related to the return of the helmet are the responsibility of the customer.

We remind you that the products purchased are subject to the legal guarantee of conformity granted by the manufacturer, in accordance with the European legislation applicable in this area.

 

Guarantee

Information on the legal warranty period:

The legal guarantee of conformity is based on Article L. 211-4 through L. 211-14 of the Consumer Code as well as Article 1641 of the Civil Code concerning defects noted.

S.A.S NACA and UFO are liable for defects in conformity of the goods with the contract and for hidden defects in the item sold.

When acting as a legal guarantee of conformity, the consumer:

-benefits from a period of two years from the delivery of the property to take action;

-can choose between repairing or replacing the goods, subject to the cost conditions provided for by the Consumer Code;

-is exempt from providing proof of the existence of the lack of conformity of the goods during the 24 months following delivery of the goods. The consumer can decide to implement the guarantee against hidden defects in the item sold. In this case, he can choose between canceling the sale or reducing the sale price.

To benefit from the product warranty, you must keep the product purchase invoice. The warranty start date corresponds to the invoice date.

Any warranty is excluded in the event of misuse, negligence or lack of maintenance on the part of the Purchaser, in the event of normal wear and tear of the goods or force majeure, as well as in the event of a fall or impact; in accordance with the safety requirements for personal protective equipment, according to standards EN1384:2017, EN1078:2013+A1 and according to regulation R22.05:

“The helmet is designed to absorb part of the energy of an impact with partial destruction of the shell or the interior padding, or both. This damage may not be visible and therefore any impacted helmet must be destroyed and replaced with a new one.


Disputes – Competent court

These General Conditions of Sale and the purchase and sale operations resulting from them are governed by French law.

They are written in French. In the event that they are translated into one or more languages, only the French text will be authentic in the event of a dispute. In the absence of an amicable resolution, the dispute will be brought before the Commercial Court to which the companies S.A.S NACA and UFO fall.


Consumer dispute mediation system

In accordance with articles of the Consumer Code L611-1 and ss and R612-1 and ss, it is provided that for any dispute of a contractual nature relating to the execution of the sales contract/or the provision of services which could not be resolved as part of a complaint previously submitted to S.A.S NACA / UFO customer service, the Consumer may resort to mediation free of charge. Changes to the general conditions of sale

S.A.S NACA and UFO reserve the right to modify its general conditions of sale at any time and therefore invites its members to consult them regularly. By validating his orders, the customer accepts the new terms of the general conditions of sale.

Members who do not wish contractual relations to be governed by the new general conditions of sale must notify this on the date from which the new conditions will take effect and must cease using the services of S.A.S NACA and UFO – NACA HELMET.
